Nicole’s Motivation Case Analysis
Nicole will develop and provide me with distinct work schedules indicating how she has prioritized her duties (ability). I will help her out with reminders for the first two weeks after which she will be expected to perform all duties, in order of prioritization without being reminded. By the end of the first month this would have helped her to develop her organizational and self-management skills. In addition, this will make her more responsible with regards to meeting deadlines. Most importantly, this is useful in helping her keep track of her work, meet deadlines and be able to provide information about her work progress proactively. Nicole will also be expected to address different work environments without compromising efficiency (ability). This will be instrumental in helping her mange work relations with ease and avoid conflicts that undermine optimal performance. Furthermore, this will be important in helping her to manage changing work environments effectively.
Nicole will be expected to manage jobs ht require teamwork (opportunity). This will enable her to learn how to relate with her colleagues and address emergent concerns accordingly. Drummond Hall Advertising will be expected to provide Nicole with jobs that require consultation and follow up (opportunity). Coupled with the need for teamwork, this will enable her to perfect her social skills. In addition, Nicole will be required to attend more training sessions regarding employee performance as well as well as the importance of teamwork (opportunity). The company provides training sessions once every month. By the end of six moths, Nicole needs to have perfected her social skills and reduced incidences of work related conflicts significantly.
I will monitor the performance of Nicole and provide her with feedback about her progress. This will be undertaken on a weekly basis and will provide insights regarding what she needs to do in a bid to enhance accuracy. Nicole will be expected to work on the weak areas and provide a personal report regarding her improvement every week. This is aimed at helping her to avoid mistakes and improve the quality of work. She will be expected to participate actively in this and even make contributions to measures she perceives challenging (to motivate her). Then, Nicole will be promoted to be in change of her colleagues in the advertising department (need for power). This is based on the premise that previously, she has exhibited a tendency to be domineering and influential. Putting her in charge of her colleagues will satisfy her drive for power and enable her to perform better. In addition, this will help her to work well in her position, as she is very self-oriented. Her performance will be monitored and would be promoted further if this improves.
Also, the organization should provide her with an opportunity to experience wok environments in other organizations (opportunity). This is a mode of motivation that exposes employees to other work environments within the same field of specification The aim of this is to enable Nicole to understand how the respective systems work and learn form these (positive reinforcement). This can go a long way in helping her to improve her relation sand avoid conflicts that compromise performance (Tosi, Rizzo and Mero 112).
Then, Nicole will be required to take over training sessions in after a period of six months (need for power). She will be expected to address wide-ranging issues such as employee relations, performance and motivation and so forth. This will enable her to not only exercise her authority but to also learn about the importance of maintaining positive employee relations in a bid to ensure sustainable growth and development. Nicole will be expected to provide me with her weekly budget for approval before expenditure (to avoid extinction). Monitoring her expenditure will be instrumental in enabling her to meet her personal as well as institutional budgetary goals by aligning expenses to revenue (Daniels and Daniels 46). Then Nicole will be given more jobs requiring proof reading by working for more hours than what she is working for now. This is aimed at enhancing her performance and motivating her to pay more attention to details and accuracy. By the end of three weeks, her work will be evaluated she will be rewarded with a salary bonus in line with increased efficiency (positive reinforcement).
Evaluation of the quality of her performance will be done at the end of every month and each time, she would be rewarded for any improvement (continuous reinforcement). This will be aimed at motivating her to persistently perform well under all circumstances and in all environments. Then, the organization needs to limit her use of her telephone. Regardless of the fact that this is n her line of duty, monitoring measures should be undertaken to ensure that this is only used during working hours and for professional reasons. In addition, performance or results of this should be monitored and rewarded accordingly (reinforcement). This would ensure that Nicole does not waste time on the telephone; rather she pays particular attention on achieving results.

The HIPAA Laws Being Ethical And MoralThe HIPAA laws provide protection to individual’s identifiable health information with the benefit of protecting public health. The Privacy Rule particularly permits disclosures exclusive of individual approval to public health authorities authorized by law to gather and obtain the information for the reason of preventing disease, disability or injury, including but not limited to public health observation, examination, and intrusion (Stephen, 2003).
Confidentiality- Privacy Rule
With the case of the wife asking the husband’s medical results, the physician cannot let out the results to her since the results are confidential. HIPAA laws Title II defines guidelines of maintain privacy of one’s identifiable health data. Confidentiality is crucial in ethics where third parties ask for information on medical data collected. In this case the physician should ask the third party (wife) to talk to the patient and agree about the information. In addition a disclosure must be signed by the patient declaring the rights of the third party to know about the results. The HIPAA Privacy Rule legalizes the disclosure and use of Protected Health information held by medical clearing (Stephen, 2003).
Telephone Etiquette
Health care telephone calls ignorance can be dangerous for the health care since the nurses, doctors and other medical administrative staff depends on the receptionist to create a welcoming and friendly front office for the patients. The receptionist is responsible for maintaining an effective environment where patients questions are answered, new patients are registered, appointments are scheduled and records updated. In cases where the receptionist is reluctant to pick calls, one should inform the office administration manager (OAM) to supervise and observe the behavior. Then the (OAM) should call the receptionist and remind her about her duties, and all the telephone etiquettes in a calm manner ask why she/he will not receive calls. Resolve the issue and give a warning of taking measures against it (Percival& Parker, 2009).
Medical error
When a client leaves the hospital without her medical results then definitely she will come back for them however, in cases where a medical error has occurred and a patient has been given the wrong results, then one should invite her to the hospital for another test to verify the results and give the accurate results. Explain you had two samples taken to the lab, one was either positive/valid and the other showed invalid. This time ensure there are no costs occur by the patient since it was a hospital error. Do not give her results at the shopping mall since privacy rule demands on privacy and professional ways to handle information.
Confidential data
One should keep the information confidential about the neighbor. One can choose to help or to keep quiet depending on the relationship you have with the neighbor. If she is friendly, then try to be closer and help her without mentioning about her health unless she tells you about it. In case she confesses her diagnosis don’t tell her you saw the file at the practicum site since it might demoralize her to feel exposed and her information not secure (2013).
Beneficence
It is the patients right to Make decision regarding who should know and be involved in the procedure. Therefore respect the patient’s decision and wait for the next procedure that shall take place without any obligations from the patient. The practitioner should act in the interest of the patient Beneficence (Stephen, 2003).
Loyalty
Having a sick child, I would bring her to the healthcare for check up and she will be diagnosed with the medicine required for her sickness. Taking the medicine would be fraud therefore bringing her for treatment would be the right procedure like the other patients. Equality should be maintained among the staff as well as the patients (Percival& Parker, 2009)
Employees Etiquettes
Every employee has equal rights of existence it the health care and therefore unless one is sick and has been given a sick off permit to exit early from work every other employee should exit the same time as the others. Since it is illegal to leave work early it is advisable to report this matter to the supervisor who should enquire why they go home early and warn them from leaving before time (Percival& Parker, 2009).
Conclusion
HIPAA laws should be observed and put into actions. Those that violate the laws should face the law and be answerable for violation.

Hinckley Forums: Restorative/Therapeutic Justice – A Need for Alternatives to Traditional Prosecution

The Hinkley forum was hosted by Carnol. The Hinkley institution was established by Hinkley in 1965 with the objectives of teaching practical politics and citizenship interest in National Governance and Policies. The guest, Sim Gill, Salt Lake County District Attorney, is a veteran champion of criminal justice and alternative prosecution. He was elected in November 2010 to serve as the county district attorney. Gill holds Bachelor of history and Philosophy from Utah University and PhD in Natural Resource and Environmental law from Lewis and Clark school of law (Hadley, 2001). He has a long history in fighting for the rights of the victims by focusing on communal problem-solving aspects rather than criminal indignation. Crimes that committed in the society have adverse effects not only on the victims, but to the society as a whole. Therefore, restoration of justice entails repairing all the injuries caused by criminal acts. Although the focus has been incrimination as a way of addressing these injustices, alternative approaches should be considered. The focus of this debate therefore emphasizes on restorative and therapeutic Justice as a more effective mechanism attaining criminal justice.
The “zero Tolerance” principle of the justice system emphasizes on prosecution and holding the offenders accountable for their actions and acts. This principle has dominated the society (especially the criminal and justice institutions) because it is believed to be a public policy that is effective in restoring justice. However, little attention is accorded to the most affected persons, the victims, since this policy is founded on bringing to books the offenders. Notably, the assumptions under which the “zero Tolerance to crime” operates are often ineffective (Zernova, 2007). For instance, this poor public policy assumes unlimited resources and time in the legal system. This is contrary to the economic policy of scarcity of resources. In attempting to resolve the efficiency in justice system, “smart prosecution” is preferred over the ineffective, uneconomical, and inefficient “zero Tolerance to crime” system.
The criminal justice system of the United States is characterized by resource depletion, poor methodologies that do not produce the expected justice results and frustrations to the society as a whole (McMahon, 2003). Over the last one decade, the population of prisoners has risen by 700% with the expenditure expected to be in the excess of $60 billion from the current $9 billion. Despite this massive investment in the justice system, the crime rate has been on the rise thereby indicating a negative return on these financial investments in the justice system (Zernova, 2007). Notably, majority of the prisoners suffer from chronic mental illnesses, drug and substance addicts, adverse poverty victims, and family violence related backgrounds. Taking a look at their backgrounds and historical facts, smart prosecution is a feasible solution to such suspects compared to the traditional prosecutio.
The traditional prosecutio system that roots for jailing criminals is uneconomical and is a waste of public coffers. This is attributed to the fact since over 50% of the criminals and offenders are reported to suffer from mental related illnesses, recommending prosecution is a tall order with no direct positive impacts on all the victims, society, and the criminals themselves (McMahon, 2003). This is backed by the fact that over 50 percent of the released prisoners hardly take three years before being convicted for criminal acts again. The “zero Tolerance to crime” system is a limited process of restoring justice because of its financial and economic burden to the society. The cost incurred in conducting fair and just trial is relatively expensive unaffordable than the outcome derived from such process (Hadley, 2001). In addition, this traditional system of seeking justice is costly in terms of time as the process is bureaucratic and entails a number of unnecessary steps that only succeeds in delaying justice to the victim and to the offender.
Owing to the weaknesses of this system, restorative/therapeutic Justice is a better and effective approach that is sustainable in restoring justice. This alternative system (popularly referred to as the smart prosecution) takes into account the economic principles of scarcity of resources. Unlike the traditional judicial system, that emphasizes on detaining the offenders, the smart prosecution roots for delivery of justice by freeing the offenders. In particular, the non violent offenders with medical and mental illnesses should never be detained in correction institutions, but be admitted to health and clinical institutions as a way of facilitating rehabilitations and treatment process (McMahon, 2003). This correction mechanism does not entail compromising the legal process, but emphasizes on the sustainable and long term rehabilitation. Besides, it is a shorter process that is economical in nature thereby saving sufficient resources for other violent cases.
In conclusion, criminal justice is an important process to the society. For the victims, the restoration process entails accountability and restitution, while for the society; this process involves safety and costs aspects. To the criminals, the process should be founded on treatment and rehabilitation. For this reason, jail should be viewed as an opportunity to stabilize and restore justice rather than delay it. Taking into account the economic and social factors surrounding the traditional prosecutio, restorative/therapeutic Justice is a better approach to solving criminal injustices in the society.
