There have been a lot of concerns on the numbers of illegal aliens entering the United States and the impact they bring to the continent. These illegal aliens have not entered United States without the government knowing, but have also desecrated the United States law and even its municipalities. At the local and state levels, arresting, sentencing, prosecuting and supervising these illegal aliens termed to be criminals is a big problem (Clark & Anderson, 2000). Six different states have filed suits that have forced the federal government in reimbursing them for the criminal justice costs connected with these illegal aliens. They have stated that it is the responsibility of the federal government in keeping the illegal aliens out of the country and expelling those who are in the country.

This essay shows the characteristics of these illegal aliens in the criminal justice system at state, local and federal levels. The analysis done at the federal level is based on the data from the United States Sentencing Commission that contains info on the criminal defendants who have been sentenced according to the 1984 Sentencing Reform Act and Pretrial Services Act Information System that contains info of charged defendants having federal offences (Clark & Anderson, 2000). The numbers of the illegal aliens that are in the federal criminal justice have shot up sharply. This is because the border enforcement was increased, increase in inhabitant illegal alien population and better identification methods used for the illegal aliens.

Other different factors may also play a role in the numbers of increased illegal aliens in the federal criminal justice. In determining what leads to the changes in criminal activities, Pretrial Services Act Information System and United States Sentencing Commission data are limited. After the introduction of Operations Hold the Line and Gatekeeper, the population of these illegal aliens’ defendants that were accused and convicted of crossing the border illegally increased. Even though the convictions for these offenses increased in other different districts, not the two districts that were the homes of the initiatives. Missing any details on the law enforcement initiatives in the data sets associated with every arrest, conclusions on the links between arrests and enforcements become suggestive. The ability in tracking the level of changes in criminal activities on the illegal aliens will be enhanced if increased data on the aliens is collected.

The Cook County analysis showed that the enormous majority number of illegal aliens offenders in New York, California, Illinois and Florida were people who entered with no knowledge or permission issued form the government of United States (Clark & Anderson, 2000). Many illegal aliens that have apprehended themselves at the local level are long term immigrants.

In conclusion, by increasing the prosecutions and convictions of these illegal aliens, numbers and estimated costs used in supervising and incarcerating defendants who were convicted in the federal courts were affected. Incase the efforts of border interdiction reduce attempts in illegal entries by these aliens; the negative effect on the federal criminal justice system may be o short basis. For the criminal activities among the illegal aliens to reduce, the number of EWIs is supposed to be reduced. By reducing the population of the illegal aliens coming to the United States may have emotional impact on crime rates beyond the United States Mexican border.

Introduction

Decision making revolves around making a choice between two conflicting alternatives. It goes without saying that all choices have consequences and benefits. In most cases, there is a clear line between the issues pertaining to the choice to be made, in which case an individual would not have much of a problem. However, there are instances where one would be faced with two choices, none of which would be resolving the problem in a way or manner that can be said to be ethically acceptable (Alexander, 2012). These are known as ethical dilemmas, which are complex situations usually involving an obvious mental conflict in an individual between varied moral imperatives (Howell, 2013). Following one moral imperative would lead to the transgression of another.

While I have faced varied ethical dilemmas, the most vivid one comes as the one involving information access. It goes without saying that the introduction of emails into the business world created an entirely new ground for the cropping up of moral dilemmas pertaining to information privacy and access. At one time, I was working as a data analyst in one of the biggest casinos in my hometown. I was struggling to clear some crucial project when I realized that I missed some data and information, which was sent through my co-worker’s email. Unfortunately, I could not reach him on his phone. However, I had seen him on countless times keying in his password, so I decided to log in and send the files to my email. Once I had logged in, however, an email pertaining to gambling bets that my coworker had placed some days ago with another sports book popped up. It is worth noting that casino employees are forbidden from participating in gambling activities as such activities would be likely to result in conflict of interest. I had an obligation of reporting my coworker to the management. However, such an action would have amounted to an admission of having violated the casino’s regulations pertaining to information technology through logging into my coworker’s computer. On the same note, warning my coworker against betting would necessitate revelation of the source of the information. This meant that any action that I took would be transgressing another moral rule or obligation.

In resolving this ethical dilemma, I used the three-step strategy. First, I analyzed the likely consequences of any action that I would have taken including the positive and negative consequences that apply to each of them. The key questions here were on who would benefit or lose from the action, what were the benefits or loses in this case, as well as how this action would look both in the short run, as well as the long run (Howell, 2013). These questions were asked so that I could determine the course of action that provided the most desirable blend of benefits over and above harms.

The second step revolved around analysis of the actions from an entirely different perspective that did not consider the consequences. This analysis solely concentrates on the actions themselves in an effort to determine how they measured up against varied moral principles such as equality, honesty, fairness, respect for other peoples’ dignity and rights (Alexander, 2012). Of course, I had to consider whether these actions crossed the line pertaining to things that were simply decent to things that would be considered crucial ethical principles. In this strategy, one would consider whether there is any way where one principle can be seen as more crucial than the other especially in instances where the principles conflict with each other (Howell, 2013). This is all in an effort to determine the option that comes with the least problematic actions.

The third step involved decision making, where both parts of the analysis were considered. Nevertheless, I had to consider which moral rule or principle overrode the other between honesty and protection of the employee. Needless to say, my coworker would have been handed a disciplinary action for defying the regulations, which would have possibly spelled doom on his job in the casino. This would have been the result of my honesty and strict adherence to the rule of law. On the other hand, warning him about the consequences of his behavior would have done the trick, and I was under no obligation whatsoever of disclosing my source of information.

Looking back at the decision that I made, I acknowledge that I followed utilitarian principles. This is especially considering that I took into account the net costs and benefits to all stakeholders at an individual level. The strategy that I used aimed at achieving the greatest benefit for the largest number, while establishing the least harm or preventing the most amount of suffering (Alexander, 2012). For the utilitarian approach, the most ethical option comes as the one that offers the most appropriate balance for benefits over harms for the largest number of stakeholders (Alexander, 2012). My decision to warn the coworker was informed by the fact that it had least harmful effects on his job prospects in the casino yet it would be likely to be just as effective.

However, taking a deontological approach in this case would have produced a different conclusion as I would have had to determine whether the action or decision would have been morally right or wrong only (Howell, 2013). In this case, reporting my coworker would have been the most probable conclusion.

Why is it important to recognize the difference between analysis and advocacy?

Recognizing the difference between advocacy and analysis plays a significant role in policymaking through analyzing the content of the policy and representing a group of people by enhancing their voices are heard in the society. Analyzing the policy-making procedures enables the policymakers to identify the types of public policies that are fair to the needs and the customs of the society. The four types of public policies are the regulation policies which regulate the behavior through the strict guidelines, the distribution policies which distribute the policies through the equitable framework, and the redistributive policies which are the strategies of curbing inequalities in the society through the promotion of economic, social and political development (Norwich University Online, 2020). Moreover, there exist the constituent policies which determine the government structures and powers that create procedures and rules governing the codes of conduct within the ruling body. Recognizing the analysis and advocacy also equips the students with knowledge and skills that are helpful in the evaluation of the effects of laws and policies for advocating the reforms for the improvement of policies and laws (Geugies, 2007). Notably, recognizing the policy analysis and policy advocacy enables the organization to find criteria for evaluating the policy options using the standard dimension for the analysis of the possible policy options. The analysis, therefore, creates an environment that accelerates the economic, social, and political growth within an organization.

How is the group communicating to the public?

Policymaking gets construed as a decision-making approach that involves the policymaker and the public. Effective communication should be exhibited between the policymaker and the public for comprehensive understanding. The local issue group of my interest is the American Civil Liberty Group which is responsible for shaping better policies and spreading awareness of the importance of respecting human rights policies (Donohue & Wildavsky, 2017). The American Civil Liberties Union communicates to the public through its representatives. The representatives are groups of individuals selected by the public to help in policy-making and analysis that fits the needs of the American citizen. Also, the American Civil Liberties Union can communicate to the public through a press release and press conference (Kutulas, 2006). Releasing the press involves addressing the public through the media like television and radio stations. Communicating to the public continues to involve holding seminars with the public and receiving and sending critical information through the physical presence. Other methods of communicating to the public involve defining the problems in policymaking, gathering the evidence, and identifying the causes of the challenges. After identification of the challenges, the group selects the best solution involved and develops the most effective for critical evaluation. Evaluation involves determining the costs and benefits and developing the political strategies for the policy implementation.

What relationship does the group have with government policymakers?

American Civil Liberties Union advises the government policymakers on the human rights needs of the citizen and the methodologies of framing the policies to fit the citizen’s needs. Also, the government policymakers use the local officers from the American Civil Liberties Union to analyze the policies to the public and collect public views through seminars and the public participation like the fight for women’s rights initiative (Strossen, 1991). Finally, before the government policymakers reach the final of the policy-making process, the American Civil Liberties Union representatives are consulted to air their views and grievances plus give their opinion concerning the new policy like the health policies.
