David Wilson has been elected to the board of trustees of the Houston Community College System. A year later, Wilson claimed that some board members had broken the bylaws and publicly criticized the board and school. Lawsuits against Wilson were filed in state court. By the board’s decision, Wilson was barred from serving as an officer and ordered to cease his actions. Wilson argued that the censure infringed on his constitutional rights to free speech and equal protection. After the Fifth Circuit Court of Appeals overturned the decision and remanded the case back to the lower court for further proceedings, the decision was upheld. Free speech rights and limits on elected officials’ authority to censure a member for their speech are at the crux of the matter.
Federal Rules of Civil Procedure Rule 12(b) required the district court to dismiss Plaintiff’s 42 USC 1983 complaint because it lacked subject matter jurisdiction. The plaintiff argued that the HCC Board’s public censure of him infringed on his First Amendment rights.
It was found that the plaintiff had standing and a state law claim for Section 1983 relief for a First Amendment violation, according to the Fifth Circuit Court of Appeals decision. According to the court’s precedent, the plaintiff’s claim of retaliatory censure is sufficient to establish actual injury. Thus, the court overturned the section 1983 damages claim and remanded it back to the trial court. He can no longer pursue his claims for declaratory and injunctive relief because of his removal from the Board of Directors. This resulted in a partial dismissal of the plaintiff’s appeal and a directive to dismiss plaintiff’s declaratory and injunctive relief claims on remand from the district court. Is the First Amendment restricting an elected body’s ability to issue a censure resolution?
There is insufficient evidence to support claims of mental anguish damages from Wilson’s conclusory statements, according to HCC. There are no detailed factual allegations in a complaint, but it must provide the plaintiff with a basis for claiming relief, including facts that if assumed to be true would raise the plaintiff’s claim to relief above the speculation level. That the defendant’s illegal actions have caused him mental anguish, he claims, and that he is entitled to $10,000 in damages for that anguish. Wilson’s claim for mental anguish damages is plausible based on the claims he has made in his pleadings.
On Wilson’s 1983 claim for damages, we REMAND the case and reverse the district court decision to dismiss the case because of lack of jurisdiction, in accordance with this opinion. In light of Wilson’s departure from the HCC Board of Trustees, his declaration and injunctive relief claims have become moot. To that end, we AGREE with HCC’s motion to dismiss Wilson’s appeal in part and direct the district court on remand to dismiss Wilson’s claims for declaratory and injunctive relief. According to this opinion, the case was remanded and a partial dismissal motion was granted.
Effect
The outcome of a case can have a significant impact on the parties’ actions in the future, as well as their assets, money, and mode of living. Court decisions have the most immediate and obvious ramifications. Trial and appellate courts enforce the laws enshrined in governing documents such as provisions of the constitution, statutory provisions, regulations and guidelines. It is through the decisions and interpretations of the judiciary that a policy is developed and put into action. This was the result of a decision made by the government. A court can declare a law or government action unconstitutional. As a result of judicial review, the federal courts have the power to interpret the Constitution. Litigation against government officials is a frequent topic in court decisions on constitutional rights, economic policy, due process, and other related issues. When federal judges decide whether laws or government actions are in conflict with the spirit of the Constitution, their decisions have a significant impact on the public policy. The majority opinion of a court is known as the majority opinion, and a dissenting opinion (or dissent) is an opinion written by one or more judges that expresses disagreement with the majority opinion. Many checks and balances and limitations are in place to limit its authority. The court’s decisions have a direct impact on the policies that are implemented in the future. As part of a system of checks and balances, courts ensure that the Constitution and individual rights are protected. As new members are bringing fresh perspectives to the court’s composition, so can the constitutional rules that guide policy decisions. Police procedures, prison conditions, and other aspects of the criminal justice system are all impacted by these rules. What happens in a country’s legal system has an impact on how businesses operate there. International compliance and taxation laws are also influenced by such legal systems. Central and Eastern Europe is largely governed by civil law. Legal precedents established by courts form the basis of the common law, an unwritten code of conduct. If a statute or written rule of law cannot determine the outcome, common law can be used to guide the decision-making process in those rare cases. A country’s business practices are influenced by the common law and civil law systems. In addition, these legal systems have an impact on how international business is regulated in terms of compliance and taxation. As a general rule, a civil law system is more restrictive than a common law system. It is the responsibility of the Houston Community College (HCC) System to oversee the regional system of community colleges in Houston. Abstract
This article sheds light and analyses the various problems in modern day societies. Its basis comes from intensive research in different groups of people and interactive interviews or questionnaires issued to a controlled group. The results are conclusive and aim to help identify and to help change some negative perspectives of the problems or help find solutions to them. The paper examines three randomly picked key issues that have an enormous impact on groups and the victims of such problems. The study is an in-depth approach to these problems but does not aim at providing a solution to these problems but rather bring them to light. The issues of abortion, same-sex marriage and women rights, though known are well known but often ignored. The study specifically tries to show the effect of the mentioned problems to trigger an empathic response from the reader. The paper briefly mentions the opinions and stands of different societies against these issues.
Social Problems in Societies
The society is an organization of people living together. They live with certain predefined laws, moral conducts and rules to maintain the societal integrity. Social problems, therefore, are matters that negatively affect the group in a society. Different societies view certain social interactions and behaviors differently so an issue in one society may not particularly be an issue in a different society. The existence of social problems is dependent on a society’s moral consciousness (Spector, 1987).
Problems
One of the hardest hitting societal problem is the issue of abortion. Abortion has always torn a rift between peoples’ beliefs as to when life begins. Pro-life adherents believe that life begins at conception and thus abortion is murder of an innocent child. Pro-choice adherents argue that the expectant mother has a choice to terminate or let the growing baby live. Presumably, abortion is justifiable in some circumstances (Marquis, 1989). Most churches and religious institutions do not support abortion, yet some governments allow circumstances under which it is acceptable. Most countries have laws that forbid abortion unless the expectant woman’s wealth is in danger, or she is a rape victim (Colker, 1992).
Same-sex marriage is an issue that has stirred up many emotions in modern day societies. It is the matrimonial union of people of the same gender identity. It is gaining a steady acceptance especially in the developed countries like the United States that support same-sex marriages cite their primary reason as according human rights to same-sex partners. Canada passed laws making it legal for gay men and lesbians to marry (Lahey, 2004). As expected, this issue does not sit well with those who see it as a deviation from God’s initial plan for marriage and those who perceive it as morally wrong. The Bible declares homosexuality as unnatural and immoral. The Biblical interpretation is subject to various interpretations in the modern world.
Women rights are a worldwide cause of concern. They are entitlements, privileges and rights that women should enjoy. They widely vary from equal employment opportunities for women to their rights to education. In the past, males have always played dominant roles in the society and had elevated privileges over their female counterparts. There is little attention paid to human rights of women at all levels of political organization (Tomasevski, 1993). Women right activists and supporters aim to address the perceived injustices and violations by advocating equal treatment of men and women. Women rights activism though, has raised concern in the recent past that it may lead to neglect and sideline of men and boys in the society. Women now get preference in some job opportunities and a fair allocation of key posts in the public domain.
Conclusion
Social problems exist in every society. Many societies try to tackle these social issues while others blatantly ignore them. Social issues cripple a society’s productivity and unity thus bringing about undesirable effects. There are too many concerns to enlist, but people are fighting back to eliminate them from their midst.

Heritage Foundation is an organization situated in the United States of America. Its main purpose and objective is to influence people in the society on some important matters that affect their lives. Through this, it impacts a society’s culture greatly. It looks with great extent on the topic about gayism, anti-Muslim, the importance of religion and so much more. My essay will focus on how culture has been impacted through the encouragement of religion. This is a major achievement.
According to history, America has been practicing religion with most of its pioneers being Christians. During the era of Bill Clinton he brought more arguments about how religion can impact their culture. It mostly touched on marriages and families as part of a culture in the country. The heritage foundation organization shares great ideas to see the culture of the society impacted and observed (Edwards 1997).On the issue of family, research by the organization has proved that religion to a great extent makes the families stronger. It proved that those who attend churches got their spouses easily and it’s usually very hard for them to separate or live alone. This research has also shown that those that attend churches are more likely assured to experience the joy of marriages and that of a family.
By encouraging the exercise of religion, the organization has proved that poverty would be minimal. The culture of the United States is never based on high rates of poverty, but on how to fight poverty. Without basing my argument so much on the culture of religion, the organization has also tried to look at the act of gayism in deep. Some research tilts the culture by supporting the act of gays while others try as much as they can to go against it hence holding in place its culture (Edwards 1997).
In conclusion, the Heritage Foundation has impacted to great extent the culture of the people within its vicinity. The organization can be more effective by venturing deep into the activities of each and every member in the society without looking at the class. This is because at the lower classes where people live a life of hand to mouth is where the culture is usually either xo much broken due to ignorance or it’s still intact.
