To better understand the law with respect to the roles and responsibilities of the occupational safety, health, and environmental professional, you will need to be able to read and understand court decisions and other legal decisions. You can utilize a process that involves reading, analyzing, and briefing decisions. This method is presented in the Preface of our course text.
For this assignment, you are required to read, analyze, and brief one Occupational Safety and Health Review Commission decision by Administrative Law Judges or Commissioners. You should note that the Occupational Safety and Health Review Commission is an independent agency of the U.S. Government that was established by the Occupational Safety and Health Act of 1970 to function like a court to resolve certain disputes under the Act. There are two areas of OSHA law that you might find in developing your case briefs that should be clarified. The first is OSHA’s General Duty
Clause. In order for OSHA to invoke the General Duty Clause, when there is not an existing OSHA regulation that addresses the hazard, the following conditions must all be present:
1. whether a hazard exists;
2. whether that hazard is recognized;
3. whether the hazard is causing, or is likely to cause, serious physical harm to employees; and
4. whether a feasible means exists to reduce the hazard.
The second is an often-used defense of “employee misconduct.” The argument typically goes that the employer told the employee to do it properly and it isn’t the employer’s fault the employee chose not to do so. The “unpreventable employee misconduct defense” is a hard case to prove, but here is a summary (Links to an external site.) of the issue from a law point of view. To summarize, there must also be four conditions:
1. The employer had in place a work rule adequate to prevent the violation;
2. The employer effectively communicated the rule to employees;
3. The employer established methods for discovering violations of work rules, and yet did not know about an isolated violation of the work rules;
and
4. The employer can show documented enforcement of the rule when violations were discovered. Case Brief

OBJECTIVES:

student).
2) Describe the effects of the aging process on the select individual.
3) Describe how basic human needs (according to Maslow) are or are not being met.
4) Review current literature relevant to the individual’s culture.
5) Discuss how the individual’s culture may/does influence health care beliefs, needs, and
practices.
6) Describe the individual’s developmental level using Erickson’s theory of social growth
and development.
7) Discuss literature related to culture.
GENERAL INFORMATION:

6) Identify the person’s developmental level using Erikson’s theory of social growth and
development. Provide rationale to support your assessment of the person’s developmental level
PART III – Cultural Assessment – After reading chapters 27, 45 & 30 in TLL, chapter 10 in Dudek
and viewing Leininger film, completer the following:
1) Identify the person’s cultural background including:
- a) race
- b) ethnicity
- c) religion
- d) class
- e) gender role
- f) lifestyle
2) Collect data using “Leininger’s Acculturation Health Care Assessment Tool for Cultural
Patterns in Traditional and Non-Traditional Lifeways.”
3) Collect and discuss data using the questions in Dudek (2013) p. 242 “Understanding
Acculturation”.
4) Collect and discuss data on your client’s health promotion and illness prevention beliefs
and practices including:
Identify most recent date for each as appropriate:
- a) professional exams-general physical, eye dental, gynecological
- b) sun screen protection
- c) exercise
- d) immunizations-flu and pneumococcal vaccine
- e) self-exams (breast, testicular)

(1) Choose one (1) ethnic group identified as part of this person’s background. Research the health
beliefs, values and practices predominant for this ethnic group. (Research refers to the review
of the professional literature).
(2) Documented discussion
Citing references from the professional literature, discuss each of the following
- a) role and status of elderly within the family
- b) views and practices to prevent illness, promote wellness, maintain health and
care for self and others, including complementary and alternative therapies (CAT)
as mentioned in TLL Chapter 27.

nursing practice in mental health and pediatrics with no less than 250 words and a
minimum of 2 scholarly references. Please refer to assignment for more details.

You are to identify one ethical dilemma a nurse may encounter when caring for a client with mental illness (substitute with when caring for a child and their family). Start a new entry in the forum discussion “Ethics and Legal Discussion” in which you:
- Title the entry to reflect the ethical dilemma
- Describe the dilemma and provide rational as to why there is a dilemma.
- State what ethical principles are involved
- Indicate factors involved or related to this dilemma for example, specific legislation, value or belief systems, rights of various persons
- Specify what factors or aspects should be considered in resolving the dilemma.
- Indicate what principles, accountabilities, and resources can be used to guide nurses in resolving the dilemma
- Provide specific and/or scenarios where possible- would this be very different from the dilemma they have described above. Are they providing additional examples of similar dilemmas?
